1. Use of the Websites

You may use our Sites for lawful purposes and in compliance with these Terms. You agree not to:

• Use the Sites for fraudulent or unlawful purposes
• Attempt to gain unauthorized access to any systems or data
• Transmit harmful code, bots, scripts, or automated tools

2. Agency Relationships & Required Disclosures

Your use of our Sites, submission of forms, downloading of guides, or general communications with us does not by itself create an agency relationship with Engmann Properties, Inc.

An agency relationship is created only when you complete and sign the appropriate California or Nevada real estate agency agreements, including but not limited to:

• Buyer Representation Agreements
• Listing Agreements
• Required Agency Disclosure forms

These agreements may be executed electronically through embedded third-party tools such as DocuSign.

Prior to collecting information related to your prospective offers, interest in making offers, or intentions to purchase or sell real property, we will provide the legally required agency disclosures as mandated by California and Nevada law, and these disclosures must be acknowledged before proceeding.

Until the appropriate agreements are executed, we act only in a non-agency, non-fiduciary capacity and do not represent you in any real estate transaction.

3. Real Estate Information, CMAs & Valuations

Any estimates, CMAs, price ranges, market insights, or opinions provided through our Sites are for informational purposes only and:

• Are not appraisals
• Do not guarantee market value or sale price
• May be based on limited or incomplete data
• Should not be relied upon for financial, tax, or legal decisions

You are encouraged to consult with licensed professionals (appraisers, attorneys, financial advisors, CPAs) before making decisions based on provided information.

4. Uploads, Documents & Financial Information

You may voluntarily submit documents such as:

• Pre-approval letters
• Proof of funds
• Identification documents
• Transaction-related forms

By submitting such documents, you agree that:

• You are authorized to share the information
• You understand documents are used solely for real estate services or verification
• We may share them only with parties necessary to facilitate a transaction
• We do not use such information for marketing

5. Third-Party Services, Lead Sources & Embedded Tools

Our Sites may integrate or receive data from third-party platforms, including but not limited to:

• Facebook Lead Forms
• Google Lead Forms
• Realtor.com, Zillow, HUD, zBuyer
• Third-party valuation tools
• DocuSign and other embedded signature or form providers
• Analytics and advertising platforms such as Meta and Google

Your information may be shared between us and these partners only as necessary to fulfill your request.

Use of these third-party tools is governed by their respective privacy policies and terms. We are not responsible for the content, policies, or data-handling practices of external websites.
